These Terms of Service form a binding agreement between you and DayTradingNews ("we", "us", "our") and govern your access to and use of our website, scanner, fundamentals tools and any related services (together, the "Service").

By creating an account, subscribing to a paid plan, or otherwise using the Service, you confirm that you have read and accept these terms. If you do not agree, do not use the Service.

All content on the Service, including scanner results, signals, source badges, company fundamentals, statistics, charts, ratios and any written commentary, is provided for educational and informational purposes only.

We are not a broker-dealer, investment adviser, financial planner or tax adviser, and we do not provide personalized investment recommendations. Nothing on the Service should be construed as an offer, solicitation, or recommendation to buy or sell any security.

Trading and investing in securities involves substantial risk, including the possible loss of your entire investment. Day trading in particular carries a high risk of rapid and significant loss. You are solely responsible for your own trading decisions and should consult a licensed professional before acting on any information found here.

Past performance, backtests, screens and historical figures are not indicative of future results.

Market data, quotes, volumes, floats, fundamentals and derived metrics are obtained from third-party sources and are provided on an "as is" and "as available" basis.

We do not warrant that any data is accurate, complete, current, uninterrupted or delivered without delay. Quotes may be delayed, stale, adjusted, restated or wrong. Feeds may be halted or unavailable. Filters, signals and calculations may contain errors.

You must not rely on the Service as your sole source of information for any trading decision, and you should independently verify data with your broker or an authoritative source before acting.

You must be at least 18 years old and legally able to enter into contracts to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate registration information and to keep it up to date. You must notify us promptly of any unauthorized use of your account.

Paid plans are offered on a monthly or annual basis and are billed in US dollars in advance through our payment processor. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.

You may cancel at any time from your account page. Cancellation stops future renewals; access continues until the end of the period you have already paid for. Except where required by law, fees already paid are non-refundable.

You agree not to:

• redistribute, resell, sublicense or publicly display market data or fundamentals obtained through the Service;
• scrape, crawl, or use automated means to extract data beyond the export features included in your plan;
• share account credentials, or allow more than one person to use a single subscription;
• reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
• use the Service in violation of any applicable securities law, exchange rule, or data-provider term.

The Service, including its software, interface, design, text and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal or internal business purposes in accordance with your plan.

Third-party market data remains the property of the relevant exchange or data provider and is used subject to their terms.

The Service relies on third parties for authentication, hosting, payment processing and market data. Their availability and performance are outside our control, and their own terms and privacy practices apply to the portion of the flow they handle.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

To the maximum extent permitted by law, we will not be liable for any trading losses, lost profits, lost opportunities, loss of data, or any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

We may suspend or terminate your access if you breach these terms, if your payment fails, or if we are required to do so by a data provider or applicable law. You may stop using the Service and delete your account at any time.

We may update these terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised terms.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Delaware.
